Official Rules

NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.


1. Eligibility
The Great Ontario Outdoor Adventure Contest (the "Promotion") is open only to legal residents of the fifty (50) United States (including District of Columbia) and Canada who are at least twenty-one (21) years of age at the time of entry. Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees of Ontario Tourism Marketing Partnership Corporation, Executive Fulfillment Services or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. Participation constitutes entrant's full and unconditional agreement to these Official Rules and the Sponsor's decisions, which, subject to applicable law, are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a random draw.

2. Sponsor and Administrator

Administrator: Executive Fulfillment Services, 268 Willis Drive, Aurora ON L4G 7M3.

3. Timing
The Promotion begins on December 7, 2009 at 12:00 a.m. Eastern Time ("ET") and ends on May 16, 2010 at 11:59 p.m. ET (the "Promotion Period"). The Sponsor's computer is the official time keeping device for this Promotion. The time that an entry is received by the Sponsor will be the time at which it is received by the Sponsor's mail server or web server (as applicable) as determined in accordance with the applicable server's clock.

4. How to Enter
During the Promotion Period, visit www.ontariotravel.net/outdoor and fill out the online entry form in full and submit the form. Alternatively you can enter by calling 1-800-ONTARIO (668-2746). (Hours of operation: 8:00am to 8:00pm Monday to Friday, 9:00am to 6:00pm Saturday, Sunday and Holidays; all hours are ET) and providing the requested information. Limit: Limit one (1) entry per person or per household, during the Promotion Period regardless of method of entry. A person entering on line must provide a valid email account associated with a domain that can be identified by a reverse domain name search as part of their contact information. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified.

5. Entrant Selection
On or about May 20, 2010, the Sponsor or an independent judging agency will conduct a random draw to select one (1) entry for the prize described below in Section 7 from all valid entries received during the Promotion Period. On or about May 21, 2010, the selected entrant will be contacted by email, telephone or registered mail using the information provided with the entry and may be declared a winner subject to verification of eligibility and compliance with the terms of these rules. Due to legal requirements in Canada, if the selected entrant is a Canadian resident, he/she will be required to correctly answer, unaided, a mathematical skill-testing question administered over the telephone at a time mutually convenient to the selected entrant and the Sponsor or independent judging agency, in order to be eligible for the prize. Selected entrant will also be required to sign and return to the Sponsor, within fourteen (14) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release in order to claim his/her prize. Failure to respond to the initial phone call (email or registered mail) within five (5) business days of date of notification will result in disqualification. If the selected entrant cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, or if the prize or prize notification is returned as undeliverable, the selected entrant forfeits the prize and the initial selected entrant will have no further recourse against the Sponsor, Administrator or any person or company associated with this Promotion. In the event that a selected entrant is disqualified for any reason, the Sponsor will award the prize to an alternate entrant by random drawing from among all remaining eligible entries, and following the same steps as outlined above for the initial selected entrant. Subject to applicable law, the Sponsor's decisions as to the administration and operation of the Promotion and the selection of the entrant are final and binding in all matters related to the Promotion.

6. THE SELECTED ENTRANT FOR THE PROMOTION IS SUBJECT TO VERIFICATION BY the SPONSOR AND /OR the ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.

The selected entrant must comply with all terms and conditions of these Official Rules, and receipt of the prize is contingent upon fulfilling all requirements. The selected entrant may be required to provide the Sponsor or Administrator with documentation that shows he or she was an eligible participant. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The selected entrant may be required to show proof of being the authorized account holder. Given the nature of the prize, in order to participate the winner and each of his/her travel companions must be of suitable health. The Sponsor reserves the right to require a letter from the individual's physician stating that their participation will not pose any material risk to the individual's health.

7. Prize
ONE (1) PRIZE: Prize winner will receive an eight (8) day/seven (7) night Great Ontario Outdoor Adventure of a Lifetime prize package for the winner and three (3) guests that will include the following:
  1. Round trip coach air transportation for four (4) persons from the major city airport closest to the winner's residence serviced by Air Canada to Sudbury, Ontario, Canada. The selected entrant and his/her travel companions must have the same origin and destination and must travel together at all times. The winner and his/her travel companions will fly into Sudbury, Ontario and fly out of Toronto, Ontario. Prize must be redeemed in its entirety in August 2010. If the selected entrant is not able to travel during the specified time, he/she will forfeit the prize and the Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Travel restrictions and blackout travel dates apply.


  2. An eight (8) day car rental (full size Sports Utility Vehicle) ("Courtesy Car Rental"). Courtesy Car Rental includes fuel, pick up and drop off services between car rental location and airport. Entrant or at least one of the entrant's travel companions must be qualified to rent an automobile from a national car rental agency, have at least one major credit card in good standing (that is supported by a predetermined line of credit) and have a valid Canadian or US driver's license. Courtesy Car Rental does NOT include Collision Damage Waiver, Personal Accident Insurance and Supplemental Liability Protection coverage. Winner will be required to obtain this coverage and will be solely responsible for the cost of this insurance coverage for the rented vehicle. An additional fee may apply if the winner is under 25 years of age, which the winner will solely be responsible for. Two (2) drivers are recommended, but not mandated.


  3. Seven (7) nights accommodations for four (4) persons as follows:
    • Two (2) nights standard accommodations (double occupancy for two rooms) at the Fairfield Inn and Suites by Marriott in Sudbury, Ontario.
    • One (1) night standard accommodation (double occupancy for two rooms) at the Rainbow Lodge-Birch Island located on the Whitefish River First Nation, near Little Current, Ontario.
    • One (1) night standard accommodation (double occupancy for two rooms) at the Southbay Gallery and Guesthouse located in South Baymouth, Manitoulin Island, Ontario.
    • Two (2) nights standard accommodations in a two (2) bedroom cottage at Mac's Shacks Cottages, Lookout Bay, Lion's Head, Bruce Peninsula, Ontario.
    • One (1) night standard accommodation (double occupancy for two rooms) at the Blue Mountain Inn in Collingwood, Ontario.

  4. Activities for four (4) persons including:
    • Welcome reception on the day of arrival in Sudbury.
    • Guided visit (admission included) to Science North and Dynamic Earth attractions in Sudbury, Ontario.
    • Float plane tour over the Sudbury Basin.
    • Guided hiking tour of Onaping Falls, one of the most impressive waterfalls in the Lake Huron watershed.
    • Guided tour of the Ojibwe Cultural Foundation and Wekwimikong Reserve on Manitoulin Island.
    • A ride aboard the MS Chi-Cheemaun Ferry from South Baymouth to Tobermory.
    • Interpretive tours of Misery Bay Provincial Park and Bruce Peninsula National Park, including guided hiking, cycling and kayaking adventures (rental of equipment and safety gear is included).
    • Guided boat tour to Flowerpot Island and to the Cove Island Lighthouse.

  5. The following meals for the winner and each of his/her three (3) travel companions: Seven (7) breakfasts, eight (8) lunches and seven (7) dinners. Taxes and gratuities on the meals are included. Alcoholic beverages are not included.


  6. A Nikon camera package for the winner, which includes one (1) Nikon Digital D3000 SLR Camera Kit (model D3000 with AF-S DX NIKKOR 18-55mm f3.5-5.6G lens), four (4) Nikon COOLPIX S230 digital cameras, and four (4) pairs of Nikon Travelite V compact binoculars (model 8X25 CF).


  7. A Mountain Equipment Co-Op ("MEC") Prize Pack, which will include four (4) $500.00 CAD gift cards, redeemable at any Mountain Equipment Co-Op Store in Canada or for purchases made online. Gift cards are redeemable for products or services at MEC. They are not redeemable for cash. Gift cards must be redeemed in advance of the trip.
Approximate retail value of the Prize is $ 19,000.00 USD / $20,000.00 CAD, (based on currency conversion at start of the Promotion), which may vary based on rates available at time of booking. Prize must be redeemed in its entirety in August 2010. If the selected entrant is not able to travel during the specified time, he/she will forfeit the prize and the Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. No cash equivalent for the Prize. All portions of the Prize are non-transferable and no substitution will be made except as provided herein at the Sponsor or Administrator's sole discretion. The Sponsor and the Administrator reserve the right to substitute any listed Prize for one of equal or greater value for any reason. Any unused portion of the Prize value is forfeited. Neither the Sponsor nor the Administrator is responsible for the weather conditions or activity availability and no refund or credit will be issued and no alternate date will be made available should the selected dates limit any element of the Prize usage.

The Prize winner and his/her travel companions are responsible for obtaining all necessary travel documentation including passports and visas, as applicable and for compliance with any customs and immigration requirements. The minor travel companions must be accompanied by their parent or legal guardian. It is recommended that the Prize winner and his/her travel companions obtain sufficient personal health insurance prior to departure. All expenses and travel costs, including but not limited to, transportation, personal charges at lodging, security fees, taxes, meals, beverages, room service, entertainment, merchandise, souvenirs, local and long distance telephone calls, gratuities, applicable taxes, incidentals, and all other expenses not expressly mentioned as included in the Prize description are the sole responsibility of the winner and his/her travel companions. The odds of winning the Prize depend on the number of eligible entries received during the Promotion Period.

8. Entry Conditions and Release
By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and/or the Promotion judges which are binding and final in all matters relating to this Promotion; (b) release and hold harmless the Sponsor and the Administrator and each of their respective parent, subsidiary, and affiliated companies, the Prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Promotion, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the "Released Parties") from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance or use or misuse of Prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsor and the Administrator from and against any and all claims, expenses, and liabilities (including reasonable legal fees) arising out of or relating to an entrant's participation in the Sweepstakes and Promotion and/or entrant's acceptance, use or misuse of Prize.

9. Publicity
Except where prohibited by law, participation in the Promotion constitutes the winner's consent to the Sponsor's and its agents' use of the winner's name, likeness, photograph, voice, opinions and/or city of residence for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions
The Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Promotion play, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, the Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, the Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

12. Disputes
This Promotion is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited by law. Participation constitutes entrant's full and unconditional agreement to these Official Rules and the Sponsor's decisions, which are final and binding in all matters related to the Promotion. By entering this Promotion, the entrant agrees that the courts of the Province of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of this Promotion's Rules and Regulations or the running of this Promotion.

For residents of Quebec only. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the "Régie") for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping parties reach a settlement.

13. Termination
The Sponsor reserves the right, in its sole discretion, with the consent of the Régie to terminate, modify or suspend the Promotion, or modify the Promotion Rules and Regulations at any time for any reason whatsoever.

14. Entrant's Personal Information
The Sponsor reserves the right to contact entrants and all other individuals whose email address is submitted as part of this Promotion. No further marketing communications will be received by entrants unless entrants provide explicit permission to do. Information collected from entrants is subject to the Sponsor's Privacy Policy, which is available at www.ontariotravel.net.

15. Promotion Results
For a copy of these Official Rules, send a hand-printed, self-addressed, stamped envelope to Great Ontario Outdoor Adventure of a Lifetime Contest c/o Executive Fulfillment Services, 268 Willis Drive, Aurora ON L4G 7M3 no later than April 15, 2010. Requests for the winner list must be received by June 30, 2010. U.S. residents may exclude return postage. Alternatively, you can obtain the Promotion results by calling 1-800-ONTARIO (668-2746).
